Terms and Conditions

Dear customer:

Ersal Money Transfer (“Ersal”), provides money transfer service (“Service”) through the ERSAL online site and application. Though, access to and use of the Service is subject to ERSAL terms and conditions, we encourage you (“Customer”) to read and accept the following terms and conditions for Ersal’s electronic services. Your registration with and use of any of these electronic services constitutes your acceptance of these terms and conditions and your agreement to comply with them.

  1. Ersal electronic service, through the ERSAL website and application, enables the Customer to utilize a number of services, such as adding beneficiaries, transferring money, and status inquiry for transfers.
  2. Ersal pledges to treat the fairly and equitably and adhere to the principle of disclosure and transparency
  3. Customer is required to open an account/membership through an Ersal branch, in order to perform money transfers, and upon renewing Customer ID. Also, customer is required to notify ERSAL in writing of any changes to address/mobile number, and the last address/ mobile number provided by Customer which shall be deemed the approved contact address/mobile number. ERSAL shall be entitled to block the CIF without any prior notice.
  4.  Customer is required to complete their data and the beneficiary’s data with accuracy; also, Customer agrees to exempt Ersal from any liability, claim, or compensation in the event of (a) inaccuracy or lack of data provided by Customer, including the beneficiary's data, ; (b) not processing the transfer for any reason outside of Ersal’s controls; (c) failure to execute for any reason concerning the Customer, beneficiary, or any other party
  5. Customer acknowledges that they are not legally prohibited to deal with Ersal or to provide Ersal with correct and accurate data and information, and they have read, understood, and accepted the current terms and conditions in addition to the ERSAL.
  6. Ersal has the right, to cancel a transaction in the case that Customer does not respond to any inquiries within 10 ; accordingly , Customer shall bear all expenses related to said transaction.
  7. Ersal may adjust the approved limits of transactions/remittance as required by ERSAL policy and Ersal internal procedures.
  8. Transfers globally may be made in foreign currencies. The currency exchange is performed at the exchange rate announced by ERSAL in a timely manner and applied by the sending company on the date of transfer. The price of the product/service may be affected accordingly.
  9. The exchange rate applicable to the transfer will be subject to ERSAL’ terms and conditions, which shall be implemented by "ERSAL" on the day of the remittance. The exchange rate may be affected by changes in foreign currency rates.
  10. In the event of refund, amendment of transfer (s) or change in original instructions, the applicable exchange rates are those applied on the day of change/ refund/ amendment of instructions; any additional costs incurred in processing the refund of a transaction shall be borne by the Customer (the amount refunded to the customer will not exceed the principal remittance amount).
  11. the remittance payments will normally be made in the currency of the destination country (in some countries payment is available only in an alternate currency). All currency is converted at ERSAL’s then current rate of exchange, calculated based on commercially available interbank rates plus a margin. Most rates of exchange are adjusted several times daily in line with the relevant closing rate of financial markets globally.
  12. Customer has authorized Ersal to execute all instructions coming from the customer or the user through the ERSAL website and application.
  13. Ersal is committed, subject to its own discretion, to execute all instructions required by the customer, provided that such instructions and transactions comply with the Ersal system, conform to Ersal's work procedures and, comply with instructions of concerned authorities.
  14. Ersal shall credit the customer's account with any funds and transactions executed by customer using the Ersal system. Customer shall be fully responsible for all obligations that arise from the use of the Service, Customer has authorized Ersal to deduct from customer’s bank account connected to the Service, without informing them, any financial liabilities resulting from using Ersal system.
  15. The customer shall incur all charges and expenses related to the Service. All remittance fees and charges may change from time to time. Such change or modification shall be effective from the date of its announcement through the available channels. The Customer continuity in dealing with Ersal shall be deemed an acceptance of such amendment or modification, the amendment to charges does not apply to any pre-adjusted transactions.
  16. Customer may cancel subscriptions pursuant to a written request delivered to Ersal and shall be fully responsible for the services and transactions executed till the date of acceptance of such cancelation by Ersal.
  17. Customer acknowledges their full responsibility for their personal use of the Ersal system through the ERSAL website and application in accordance with the established purposes and terms and conditions of such use. Customer also acknowledges their responsibility for the execution of remittance transactions performed online or via the application along with any other use performed by an authorized person through the use of access credentials, user ID, and password. Customer further acknowledges to protect the aforesaid credentials and not disclose them to any person, authority, or Ersal employee. Additionally, customer acknowledges that their password is deemed as their personal signature, irrespective of who uses it. Ersal shall not bear any damages, consequences, losses, or indemnities resulting from non-commitment by the customer to any of the aforementioned. The customer shall be responsible for the validity, correctness and regulation of all transactions performed using Ersal services.
  18. Customer shall incur all charges and expenses related to connecting their computer with the Ersal system, plus any fees paid to any service provider. After obtaining ERSAL prior written consent, Ersal may add any fees arising from any additional services required by the user through the Ersal system, and the ERSAL website and application (such as the services of other providers) and customer shall be informed, through Ersal online service, if such fees are incurred.
  19. Customer acknowledges that Ersal, its affiliates, and employees, are not responsible for any losses, damages, financial claims or the like caused by the use of Customer’s user ID and password. Customer commits to notifying Ersal, in writing, if they become aware that their user ID and password have become known to others so that Ersal can take the required action. The customer shall be responsible for all transactions and instructions sent vis their credentials until Ersal receives the written request/ notice.
  20. Customer is obligated to keep confidential all data, information, and transactions can be accessed and downloaded or stored from the internet or any other computer. Customer shall be responsible for any unauthorized use and all consequences, losses, and damages which may result from such unauthorized use including direct or indirect losses and damages caused to Ersal or Customer.
  21. Customer acknowledges that they have no ownership, intellectual, or publication rights to the programs and documents related to Ersal online service; and agrees that they shall not allow its users to copy, amend, download or transfer the online service programs to similar electronic devices.
  22. Ersal may cancel or suspend its online Service at any time , to protect the Ersal company and its customer or for any other reason that Ersal company deems necessary. Customers will be informed through Ersal channels if this happens.
  23. The customer agreed to authorize Ersal to send all correspondences and notices related to this service through customer’s mobile number or email recorded in Ersal system; and committed to take every possible precaution to keep confidential the contents of such correspondences and shall be responsible in the event of any default on this commitment.
  24. Customer agrees to authorize Ersal to record all communication and instructions, including the instruction of adding other users to the online service, and content such voice recordings, shall be deemed evidence in the event of using Ersal’s unified number.
  25. Ersal exerts reasonable efforts to ensure availability and functionality of Ersal system and shall inform customers of any interruption of the service. Ersal shall be responsible for executing user's instructions sent through Ersal system (through ERSAL website and application) and received by Ersal. Ersal shall not bear any responsibility, losses or indemnities resulting from fault, failures or defects in the equipment’s and communication lines which may have an effect on the accuracy of the messages sent by the user or on the receipt of customer’s instructions.
  26. Ersal shall not present any representations or warranties in relation to quality, swiftness, performance, accuracy or the like, and shall not undertaking that service shall be free of defects or errors. Customer agrees to disclaim Ersal of all issues related to such defects and errors, provided that such defects and errors are not caused by breach or negligence on the part of Ersal
  27. In the event of any damage caused by the suspension of Service, Customer shall be entitled to submit a written complaint to Ersal company stating the damage caused by the interruption of the service for resolution of the compliant whenever possible. Ersal shall not be liable for any consequences that may occur if the service is totally or partially interrupted for any emergency reason beyond Ersal ’s control.
  28. The data and information the user receives from Ersal or any other service provider shall be deemed reliable and the user shall be provided by such data and information on the basis of exerting the possible efforts to ensure its ease. Yet, accuracy of said information is not guaranteed and, consequently, Ersal shall not be liable for any shortfall, inaccuracy, or delay of such data and information, or for any decision made by others based on such information .
  29. Ersal shall not be liable for any computer virus or problems related to the information arising from the services provided by any of the information providers or resulting from the user’s personal computer. Ersal shall also not be responsible for any piracy or fraud actions.
  30.  Ersal shall make efforts to solve any technical problems that may face the users of the Service, and said problems should be reported by the Customer through Ersal channels or ERSAL web site or application, or Ersal phone numbers or branches as soon as possible, depending on the nature of the problem and the time it takes to be resolved at Ersal’s discretion.
  31. The user shall activate/end Ersal electronic service via ERSAL website or application through Ersal channels. Ersal shall not be responsible for any liabilities that may result from activation or discontinuing the Service by Customer.
  32. Customer user’s ID will be blocked automatically if ID is not used by customer for 180 consecutive days or if Customer enters the password incorrectly three times. Customer can activate the user ID again by entering the required data on password recovery page in Ersal system (through ERSAL website and application).
  33. Ersal is committed to maintaining the confidentiality of customer data. Customer’s information will not be disclosed to any third party unless Customer has been notified in advance through disclosure statements or agreements, or by obtaining authorization from Customer, or if disclosure of customer’s information has been required by authorities.
  34. Ersal has the right to change or modify these terms and condition at any time. Such changes or amendments are effective from the time they are announced via available channels. Customer’s continuation of use of Ersal services is considered as an acceptance of the amendment.
  35. Neither Ersal nor its correspondents or agents shall have any liability to Customer or beneficiary for any late payment or non-delivery to a beneficiary due to omissions, errors occurring in the electronic transmissions, equipment failure, strikes, any incorrect or unclear information provided by Customer, or error and / or misunderstanding off the third party.
  36. Customer confirms that the remittances are for personal purposes only and not for business purposes and that they own the CIF and have a direct relationship with the beneficiaries, and also that, these remittances are not made on behalf of a third party.
  37. Customer Acknowledges and understands that Saudi law forbids transferring funds to any beneficiary who is not known or has no legal relationship with the remitter, or with no legal purpose of remittance.
  38. Ersal does not accept remittances for any purpose prohibited by religion. Ersal has the right to stop this type of transactions without any obligations or responsibility.
  39. Customer agrees that Ersal may update and share Customer data, i.e., name and telephone number, with ERSAL for the purpose of providing marketing services and remittance services through ERSAL website and application. And transparency authorize "ERSAL" to disclose my information to any other agency approved by Saudi Central Bank.
  40. Ersal records and documents are correct and binding on the Customer. Customer may not object to these except in the case off any proven illegal transaction, and Ersal and its authorized agent have no direct or indirect relation with said transaction. customer undertakes to inform Ersal immediately of such event.
  41. In case payment is made via mada card, Customer agrees to the following:
    1. The card must be used by the cardholder only, and must be connected to the bank account of a user in the Kingdom of Saudi Arabia.
    2. No transfers shall be made on behalf of another person
    3. Customer shall be responsible for all transactions processed through their Ersal membership.
    4. The cardholder shall be responsible for all transactions processed by use of their card.
    5. The cardholder accepts that, Ersal records are final and binding to all parties.
    6. Transactions processed by means of the card shall be subject to these terms and conditions .
  42. Customer acknowledges their responsibility for the funds used in the transfer transactions from their account, and they must inform the official authorities of any known suspicious transactions immediately, whether or not they were aware of them at the time, and whether or not they subsequently acted in person.
  43. Ersal pledges to safeguard the confidentiality of information and refrain from using such information except for specific professional and operational purposes – subject to securing the approval of the customer- excluding information that the Ersal discloses to competent government agencies in accordance with the applicable regulations and controls.
  44. Ersal has right to take all the necessary technical and regulatory measures to protect the information technology systems and customer data in its business and the business of its branches and subsidiaries, with prudence and extend reasonable e orts in establishing, maintaining, implementing and following the controls, policies and procedures of information technology, information security, cybersecurity and data protection, including supervision and control of access to technical systems, encryption, virtual and actual protection, and having on hand the necessary plans for business continuity, recovery plans, and security plans designed to protect against any penetration, destruction, loss, interference, modification or exploitation.
  45. Any dispute which arises during the execution of these terms and conditions which the two parties fail to resolve amicably will be referred to the concerned Judicial Authorities in the Kingdom of Saudi Arabia.
  46. The Arabic language is the official language for the interpretation of these Terms and Conditions.
  47. All terms and conditions of this Agreement are subject to the instructions and regulations of Saudi Central Bank.
  48. Customer has the right to submit any complaint, claim or inquiry through the following Ersal Channels: Ersal:

Your approval in this Terms and Conditions means that you agree on all Terms and Conditions you signed on CIF Opening/ Amendment Agreement
